Mediator Directory Listing Agreement

Last updated: September 2026 Publisher: JusticeXpress, Inc. Applies to: justicexpressmediation.com

This Agreement governs the publication of a mediator's listing in the JusticeXpress Mediation directory. It is between JusticeXpress, Inc., a Delaware public benefit corporation with offices at 11582 SW Village Parkway, Suite 17, Port St. Lucie, Florida 34987 (“JusticeXpress,” “we,” “us”), and the individual mediator who applies for and is approved for a listing (“Mediator,” “you”). By submitting an application, you agree to these terms. There is no fee for a listing, and there never will be.

1. What the directory is

JusticeXpress publishes a searchable, public directory of independent Florida Supreme Court certified family mediators who conduct divorce mediation online (the “Directory”). The Directory is a curated advertising medium provided without charge to listed mediators. JusticeXpress is not a law firm, does not provide legal advice, does not provide mediation services, and does not employ, supervise, or direct any Mediator.

2. Eligibility, application, and approval

  1. Eligibility. To be listed you must (i) hold current certification as a family mediator from the Florida Supreme Court; (ii) have no pending or past disciplinary action before the Mediator Qualifications and Discipline Review Board; (iii) conduct divorce mediation virtually, by Zoom or another video platform, such that the parties need not be in the same room or county; and (iv) publish on your listing a fee for your services, stated as an hourly, per-session, or flat rate, together with what it includes.
  2. Application. You apply by completing the mediator application form. No payment method is requested at any point, because none is ever required.
  3. Verification. JusticeXpress verifies your identity, contact details, service area, and certification status against the records of the Florida Dispute Resolution Center before publishing a listing, and re-verifies annually. Verification is administrative. It is not an evaluation of competence, and approval is not an endorsement, recommendation, certification, or vouching for the quality of your services.
  4. Acceptance. Submitting the application, with the acknowledgment box checked, constitutes your acceptance of this Agreement.
  5. Discretion. JusticeXpress may decline any application in its discretion. The Directory is curated, and eligibility does not create a right to be listed.
  6. Firms. A mediation firm may list each of its certified family mediators individually under the firm name. Each listed mediator is a party to this Agreement in his or her own right.

3. Your listing content

  1. You supply and control the content of your listing, including your description of services, experience, credentials, certification status, service area, video platform, and rates.
  2. You are solely responsible for the accuracy of that content and for updating it when it changes, including any change to your certification status or licensure.
  3. Your listing describes your mediation practice only. If you are also a member of The Florida Bar, your listing may not offer legal representation or solicit clients for legal services.
  4. You grant JusticeXpress a non-exclusive, royalty-free licence to display, reproduce, and format your listing content for the purpose of publishing the Directory, for the term of your listing. You retain ownership of your content. The licence ends when your listing is removed, except for cached or archived copies outside our control.
  5. You must not publish content in your listing that is false or misleading, that misstates your certification status, or that violates any rule governing your practice.

4. The listing is free

There is no charge for a Directory listing. Not on application, not on publication, not on renewal, and not at any later time. JusticeXpress will not introduce a listing fee, subscription, tier, placement charge, or renewal charge for listings governed by this Agreement.

  1. No fee of any kind. JusticeXpress charges you nothing for the publication, display, or maintenance of your listing, for any period, at any level of visibility.
  2. No outcome-based charges. JusticeXpress charges no fee calculated by reference to, or contingent upon, any consumer inquiry, any engagement of Mediator, any mediation conducted, any outcome reached, or any fee earned by Mediator.
  3. No paid placement. JusticeXpress does not sell featured, sponsored, promoted, or priority placement in the Directory, and no Mediator may obtain a more prominent position by payment.
  4. Your fees are yours. You set your own rates and collect all mediation fees directly from the parties. JusticeXpress receives no portion of any fee you earn and has no interest in any fee agreement between you and the parties.
  5. No payment in either direction. No money passes between JusticeXpress and any Mediator for any reason connected with the Directory. JusticeXpress does not pay Mediators, and Mediators do not pay JusticeXpress.
  6. How JusticeXpress is funded. JusticeXpress earns its revenue from nonlawyer document preparation services sold directly to couples who choose to use the JusticeXpress Mediation platform. That revenue does not depend on which Mediator a couple selects, and Mediators have no obligation to promote or use the platform.
  7. Permanence. This Section 4 may not be amended to introduce any charge to Mediators without your affirmative written consent. The notice-and-continue procedure in Section 15 does not apply to this Section.

5. No referral; consumers select for themselves

  1. JusticeXpress does not refer, match, assign, recommend, endorse, or direct any consumer to any Mediator. Consumers browse the Directory and select a Mediator in their sole discretion and without input from JusticeXpress.
  2. Within each county, listings are displayed in alphabetical order by surname. Search results are not ordered, weighted, ranked, or otherwise influenced by any payment, because no payment is accepted.
  3. The contact control on a listing opens the Mediator's own website or email address as nominated by the Mediator. JusticeXpress does not collect, screen, qualify, score, or route consumer inquiries made through the Directory.
  4. Consumers who use the JusticeXpress Mediation platform may grant a Mediator of their choosing access to their case. That choice is made by the consumers alone. Platform cases are governed by the separate Platform Terms for Mediators, which a Mediator accepts only if and when the Mediator elects to accept a platform case.
  5. Nothing in this Agreement creates any obligation on the part of JusticeXpress to deliver, produce, or transmit any consumer, inquiry, or engagement to Mediator.

6. No guarantee of results

JusticeXpress makes no representation, warranty, or guarantee regarding the volume of consumer traffic to the Directory, the number of inquiries you will receive, or the number of engagements you will obtain. A Directory listing is advertising, not a source of guaranteed client engagements. Because you pay nothing for it, no refund or credit is available or applicable under any circumstances.

7. Responsiveness and currency

  1. You agree to respond to consumer inquiries that reach you through the contact information on your listing within two business days. If JusticeXpress receives a consumer report that a listed Mediator is unresponsive, JusticeXpress may pause the listing until you confirm through your account that you are accepting inquiries.
  2. Once each year JusticeXpress will ask you to confirm that your certification remains current and that you are still accepting cases. A listing not confirmed within thirty days of the request may be paused until confirmation is received.
  3. A paused listing is not removed. It returns to the Directory when you confirm. No fee is associated with pausing or reinstating a listing.

8. Your regulatory compliance

  1. You are solely responsible for compliance with all rules governing your practice, including the Florida Rules for Certified and Court-Appointed Mediators and, if you are a member of The Florida Bar, the Rules Regulating The Florida Bar, including the rules on advertising and solicitation.
  2. You are responsible for determining whether your participation in the Directory is consistent with those rules, and for obtaining your own advice on that question. JusticeXpress does not advise you on your professional obligations.
  3. You must notify JusticeXpress promptly if your certification or licensure is suspended, revoked, or otherwise disciplined, or if any representation in your listing ceases to be accurate.

9. Independent status

You are an independent professional. Nothing in this Agreement creates an employment, agency, partnership, joint venture, or franchise relationship. You control your own schedule, methods, terms of engagement, and fees. You are responsible for your own insurance, taxes, and business obligations.

10. No legal services

JusticeXpress does not provide legal advice or legal services, does not select mediators for consumers, and does not participate in any mediation. Any relationship formed between you and a couple who contacts you is solely between you and them, on terms you set, and JusticeXpress is not a party to it.

11. Data and privacy

  1. Information you provide in your application and listing is handled as described in the Mediator Privacy Statement.
  2. Because Directory inquiries go directly to you and are not routed through JusticeXpress, JusticeXpress does not receive, hold, or process the personal information of couples who contact you through the Directory. You are solely responsible for that information once it reaches you, including its security and any applicable confidentiality obligations.
  3. Handling of case information for couples who use the JusticeXpress Mediation platform is governed by the Platform Terms for Mediators and the platform privacy statement, not by this Agreement.

12. Term, suspension, and removal

  1. This Agreement begins when your listing is published and continues until your listing is removed.
  2. You may remove your listing at any time by written notice to support@justicexpress.com or through your account.
  3. JusticeXpress may suspend or remove a listing on notice if the listing contains inaccurate content, if your certification or licensure is suspended or revoked, if you cease to meet the eligibility conditions in Section 2(a), or if continued publication would in our reasonable judgment violate applicable law or professional rules.
  4. JusticeXpress may discontinue the Directory as a whole on ninety days' notice to all listed Mediators.
  5. Sections 4(d), 4(e), 6, 8, 9, 10, 13, 14, and 15 survive termination.

13. Disclaimer and limitation of liability

  1. The Directory is provided on an “as is” and “as available” basis. JusticeXpress does not warrant uninterrupted or error-free availability.
  2. To the fullest extent permitted by law, JusticeXpress is not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or lost business opportunity, arising out of or relating to this Agreement or the Directory.
  3. Because the Directory is provided to you without charge, JusticeXpress's total aggregate liability arising out of or relating to this Agreement is limited to one hundred dollars ($100).

14. Indemnification

You will indemnify and hold harmless JusticeXpress, its officers, directors, and agents from any claim, loss, or expense (including reasonable legal fees) arising out of your listing content, your services, your dealings with any consumer, or your breach of this Agreement or of any rule governing your practice.

15. Governing law and disputes

This Agreement is governed by the laws of the State of Florida, without regard to conflict-of-laws principles. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in St. Lucie County, Florida.

16. Changes to this Agreement

JusticeXpress may amend this Agreement, other than Section 4, on at least thirty days' notice by email to the address on your listing account. If you do not accept a change, your remedy is to remove your listing before the change takes effect. Section 4 may be changed only as provided in Section 4(g).

17. Entire agreement

This Agreement, together with the Terms of Use and the Mediator Privacy Statement, is the entire agreement between the parties regarding the Directory and supersedes any prior understanding, including any earlier version of this Agreement that described listing fees, founding-member terms, or subscription tiers. If any provision is held unenforceable, the remainder stays in effect. A failure to enforce any provision is not a waiver of it.
